SwaperHub – Terms of Service

Welcome to SwaperHub™, a product of RCM Streamline LLC (“SwaperHub”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of the SwaperHub platform, mobile and web applications, and any associated services (collectively, the “Service”).

By using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.

1. Eligibility

You must be of legal working age in your jurisdiction to use SwaperHub. If you are under the age of 18, your use of the Service must be supervised by a parent, legal guardian, or employer.

By using SwaperHub, you confirm that you are legally permitted to work and that you have the necessary authorization or supervision to use this platform in accordance with applicable labor laws.

Employer Accounts: Employers are solely responsible for ensuring that any team members invited to use the platform are of legal working age and that all labor laws are followed regarding scheduling, overtime, and shift assignments.

2. Account Registration & Security

You are responsible for any activity under your account. You agree to:

• Provide accurate, current, and complete registration details
• Maintain the confidentiality of your login credentials
• Notify us immediately of any unauthorized access or suspected breach
• Use caution when accessing your account from shared or public devices

We reserve the right to disable any user credentials at our discretion if we believe a violation has occurred.

3. Use of the Service

SwaperHub™ provides tools for scheduling, shift swapping, time-off tracking, and team coordination. You agree to use the platform solely for lawful purposes and internal organizational use.

You may not:

• Use the Service to violate labor laws or third-party rights
• Introduce malware or harmful code
• Scrape, index, or mirror the platform using bots or crawlers
• Impersonate any person or organization
• Reverse engineer or attempt to gain unauthorized access to the platform

4. Subscription Plans & Billing

SwaperHub offers subscription plans, as described on our Pricing page. By subscribing, you authorize recurring billing via your selected payment method until canceled. All fees are non-refundable unless otherwise required by law.

You may change or cancel your plan through your account dashboard. Downgrades may affect access to certain features.

5. Changes to These Terms

We may revise these Terms periodically. Material changes will be communicated via email or banner notice. Continued use of the Service constitutes acceptance of the updated Terms.

6. Platform Availability & Modifications

We reserve the right to modify, restrict, or discontinue any part of the platform at any time without notice. We are not liable for any service interruptions or downtime.

7. Intellectual Property

All content, features, functionality, and branding within SwaperHub™ are the property of RCM Streamline LLC or its licensors. You may not reproduce, redistribute, modify, or create derivative works without explicit written consent.

9. Prohibited Uses

You agree not to use the platform to:

• Violate any laws or third-party rights
• Exploit minors or post harmful content

• Interfere with system performance or security
• Engage in scraping or automated data extraction

Violations may result in termination and legal action.

10. Indemnification

You agree to indemnify and hold harmless SwaperHub™, its officers, employees, affiliates, and agents from any claims, damages, or liabilities arising from your use of the Service, your content, or your violation of these Terms.

11. Limitation on Filing Claims

Any claim or cause of action must be filed within one (1) year from the date it arises. After that, the claim is permanently barred.

12. Disclaimers & Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted access, data accuracy, or specific outcomes.

To the fullest extent permitted by law, SwaperHub™ disclaims all liability for:

• Loss of business, revenue, or profits
• Data loss or service outages
• Any indirect, incidental, or consequential damages

13. Third-Party Links

The platform may contain links to third-party sites. SwaperHub™ is not responsible for the content, services, or practices of those sites.

14. Arbitration (Optional Clause)

At our discretion, disputes related to these Terms may be resolved by binding arbitration under the American Arbitration Association rules in Pierce County, Washington.

15. Waiver & Severability

If any provision of these Terms is deemed unenforceable, the remainder will still apply. No waiver of any term will be deemed a continuing waiver.

16. Governing Law

These Terms are governed by the laws of the State of Washington. All disputes shall be resolved in the state or federal courts located in Pierce County, Washington.
